Do I need a lawyer or a conveyancer in Queensland?
In Queensland, conveyancing work has to be done by a law practice. There is no separate licensed conveyancer profession here the way there is in New South Wales or Victoria, so the person handling your transfer is working under a solicitor either way. At Stanford Legal your file is run by our conveyancing team with a solicitor behind it, which matters on the day something in the contract is not standard.
When should I get a lawyer involved, before or after I sign?
Before, if you possibly can. Once you have signed, your options narrow to the conditions written into the contract and the cooling-off period. A contract review before signing costs very little and is the single cheapest way to avoid a problem. If you have already signed, call us the same day, because the cooling-off period and the condition dates start running immediately.
What is the cooling-off period on a Queensland house contract?
Most residential contracts in Queensland carry a five business day cooling-off period, which starts the day you receive a copy of the signed contract. If you terminate during it, the seller may keep a penalty of 0.25 percent of the purchase price. Cooling off does not apply to property bought at auction, and it can be shortened or waived, so check what your contract actually says.
How much does conveyancing cost?
Our professional fee is quoted in writing before we start, so it does not move. On top of it sit the government and search costs, which are set by others and vary with the property: title and registry searches, council and water rates, transfer duty and the registration fee. We set both out separately in the costs agreement so you can see which is which.
What searches do I actually need?
It depends on the property. A standard residential purchase usually includes title, registered plan, council rates, water, and land tax. Beyond that we advise based on what the property is and where it sits: flood and overland flow, contaminated land, heritage, tree orders, building approvals for work that has been done, and body corporate records for anything in a scheme. We tell you what each one is for rather than ordering everything by default.
