Family Law

Family lawyers in Brisbane City

Separation, property, parenting and divorce, handled from our office at Level 4, 95 North Quay, a short walk from the Family Court in Brisbane. The first conversation is free.

Family law help, from the first conversation

Most people come to us in the weeks after a separation, unsure what to do first.
Separating raises the same questions in roughly the same order: where everyone will live, how the children's time will be shared, what happens to the house, the super and the debts, and when to apply for a divorce. We start by working out which of those need an answer now and which can wait, so you aren't making permanent decisions under pressure. From there we act for you on property settlement, parenting arrangements, child support, consent orders, binding financial agreements, protection orders and the divorce itself. Most matters settle by agreement, through negotiation or mediation, and we'll tell you plainly if yours is one that needs the court.

Family law in Brisbane: the courts and the process

Most matters never reach a courtroom, but it helps to know where they would go.
Divorce, parenting and property applications are filed with the Federal Circuit and Family Court of Australia, whose Brisbane registry is on North Quay, a short walk from our office. Before applying for parenting orders you usually need to try family dispute resolution and get a section 60I certificate, unless there is family violence or real urgency. Domestic violence protection orders are dealt with separately, in the Magistrates Court; for inner Brisbane that's the Brisbane Magistrates Court on George Street. Time limits matter too: married couples have 12 months from a final divorce to start property proceedings, and de facto couples have two years from separation.

QUESTIONS

Frequently asked questions

Can't find the answer you're after?
Where is your Brisbane office?
Level 4, 95 North Quay, Brisbane City QLD 4000, a short walk from the Federal Circuit and Family Court registry. We also have an office at Springfield Tower, Springfield Central. Your first conversation is free and can be by phone if that's easier.
How much does a family lawyer cost in Brisbane?
It depends on the issues and how much is already agreed. We quote each stage in writing before it starts, and the first conversation is free.
Do I have to go to court?
Usually not. Most family law matters settle through negotiation or mediation, and an agreement can be made legally binding with consent orders or a binding financial agreement, without a hearing.
Is there a time limit for property settlement?
Yes. Married couples have 12 months from the date the divorce becomes final. De facto couples have two years from separation. After that you need the court's permission to apply.
Which Brisbane suburbs do you act for?
All of them, including Brisbane City, South Brisbane, West End, Spring Hill, Fortitude Valley, New Farm, Kangaroo Point, Woolloongabba, Paddington, Toowong and the southside suburbs.
