What happens if I die without a will in Queensland?
Your estate is distributed under the intestacy rules in the Succession Act, which set a fixed order of who receives what. It may not match what you would have chosen, it makes the administration slower and more expensive, and it removes your say in who looks after your children. One point that surprises people: Queensland's rules can recognise more than one spouse at the same time, for example a legal spouse and a de facto partner, who then share the spousal entitlement.
How often should I update my will?
Review it every few years, and always after a life event: marriage, separation or divorce, a child or grandchild, a death in the family, a significant change in assets, or starting or selling a business. Marriage generally revokes a will unless it was made in contemplation of that marriage, and divorce revokes gifts to and appointments of a former spouse. Both catch people out.
Does my superannuation pass under my will?
Not automatically. Superannuation is held by the fund's trustee and is generally paid at the trustee's discretion to dependants or to your estate, unless you have made a valid binding death benefit nomination. For many people super and life insurance are the largest thing they will leave behind, so it is worth dealing with deliberately rather than assuming the will covers it.
Can someone challenge my will?
Yes. The most common route in Queensland is a family provision application by a spouse, child or dependant who says adequate provision was not made for their proper maintenance and support. A will can also be challenged on validity grounds such as capacity, undue influence or improper execution. Good drafting, contemporaneous file notes and, where appropriate, a statement of reasons make a claim harder to run, though nothing makes a will challenge-proof.
Do I need a lawyer, or is an online will enough?
A kit will produce a document. Whether it produces a valid will that does what you meant is a different question, and the failures show up when you are not there to explain. The common ones are execution that does not meet the formal requirements, gifts that have lapsed because the asset was sold, super and jointly owned property assumed to pass under the will when they do not, and blended family situations handled with a template. A straightforward will is not expensive. Fixing one is.
