Since 1 August 2025 a Queensland seller has to hand over a disclosure statement and its certificates before the buyer signs. Get it wrong and the buyer can walk any time before settlement. We prepare it, check the contract the agent gives you, and take the sale through to settlement.

What you owe the buyer before they sign

A Form 2 disclosure statement, with the prescribed certificates attached.
Queensland's seller disclosure regime commenced on 1 August 2025 under the Property Law Act 2023. Before the buyer signs the contract, you must give them a disclosure statement in the approved form together with the certificates it requires, which typically include a title search, the registered plan and, for a lot in a community titles scheme, a body corporate certificate.

Other items attach depending on the property, such as a pool safety certificate or notices affecting the land. If the statement is not given, or is incomplete or materially inaccurate and the buyer would not have signed had they known, the buyer can terminate at any time before settlement. That is a real risk to a sale, and it is entirely avoidable.

What happens if I do not give a disclosure statement?
The buyer may terminate the contract at any time before settlement. The right also arises where the statement was given but was incomplete or materially inaccurate and the buyer would not have signed had they known. Practically, that means a sale can collapse weeks in, after you have committed to your next purchase. Preparing the pack properly at listing is the fix.
Do I have to disclose problems with the house?
The disclosure regime is built around prescribed information and certificates rather than a general confession about the condition of the house, and buyers are still expected to make their own inspections. That said, sellers remain exposed under other law for actively concealing a defect or making a misleading statement about it, and unapproved building work is one of the things that most often surfaces. If something is on your mind, tell us and we will advise on where it sits.
Who pays what at settlement?
Rates, water and body corporate levies are adjusted at settlement so each of you pays for the days you owned the property. Your mortgage is discharged from the proceeds, the agent's commission is usually paid at the same time, and our professional fee and the search costs come out of the same settlement statement. We send you the figures before the day, not after.
Can I sell before I have bought?
Yes, and many people do. The risk is the gap between settlements. We can align the two dates, negotiate a longer settlement or a licence to occupy, or advise on making your purchase conditional on the sale. It is worth planning before you sign either contract rather than after.
How long does it take to prepare the disclosure pack?
Usually a few days, and often faster. The timing is driven by the searches and certificates rather than the drafting, and a body corporate certificate can take longer than the rest. If you are about to list, start it now so it is not the thing holding up a signed contract.
